Hemp-derived THC drinks are legal in all 50 states primarily because they contain negligible levels of THC, the psychoactive compound found in marijuana. The 2018 Farm Bill legalized the production and sale of hemp and hemp-derived products, including those containing THC levels of 0.3% or less. Since hemp contains low levels of THC and high levels of CBD, its products, including beverages, are legal as long as they adhere to federal and state regulations regarding THC content and production.
